How To Clear A Fix It Ticket

Correctable Violations Program (Fix-it-Ticket)

In addition to the alternatives listed on your citation, The City of independence has a program to allow offenders to correct specific violations and have the violation(s) dismissed through the Correctable Violations Program (also called the Fix-it-ticket program) The specific violations are;

  • Illegal Alteration-(803.550) Subsection (2), (B) and (C) only.
  • Operating vehicle without driving privileges/expired-(807-010) Only if license expired in the last 30 days
  • Failure to renew-(803.455) or improper display-(803.560) Subsection (1) (B) only.Expiration had to have occurred within the last 30 days.
  • Failure to display plate-(803.540)
  • Failure to notify upon change of address/name-(807.560)
  • Failure to notify DMV of a name or address change on registration-(803.220)
  • Operation without required lighting equipment-violation(s)-(816.300, 816.330 &816.360)
  • Illegal window tinting-(815.222) (for requirements or exceptions related to window tinting see ORS 812.221)
  • Failure to carry proof of insurance-(806.012)

Procedure to Follow:

  1. Correct the violation to be in compliance with the law.
  2. The person cited must appear at the Independence Police Department located at 555 S. Main St. Independence, OR.  Monday through Friday between the hours of 8:00 am and 4:30 pm, no later than 1 business day before the date of arraignment on the citation, (excluding weekends and holidays). You must bring the following:
    a. Your valid state identification card
    b. Your copy of the citation
    c. The vehicle listed on the citation, (if your citation is for an equipment violation)
    d. You also need to bring in the brochure (given by the officer) which has the proof of compliance form on it.

    3. The vehicle or item will be inspected for compliance. If the vehicle or item is within compliance, the appropriate compliance form will be completed and signed by an authorized person from the Police Department.
4. Take the citation and completed compliance form to the City of Independence Municipal Court Clerk located at 555 S Main St. Independence, OR.  Office hours are 8:00 am to 5:00 pm Monday through Friday. You must complete this no later than one day before your arraignment date.
5. Your driving record will be reviewed and if you are eligible for a dismissal, you must pay an administrative fee in the amount of $35.00 for each dismissed violation(s).The fee must be paid before the citation(s) will be dismissed.This procedure must be completed prior to your scheduled court appearance shown on your citation

NOTICE:

You are only eligible for this program if you have not been convicted of or had the same violation dismissed through the City of Independence Correctable Violation program within the last 12 months. YOU MUST PRESENT THE BROCHURE WITH YOUR CITATION TO BE ELIGIBLE.

Voluntary Program:

You are not required to participate in this program.  This program is provided to you as an option and is completely voluntary.  If you choose not to participate in the Traffic Court Correctable Violation Program, you must appear at your previously assigned court date and time.  This information can be found at the bottom of your citation.
